MANDAMUS & APA LAWSUITS
Still Waiting on Your Immigration Application?
An immigration delay or a gap in work authorization can put your plans on hold. MC Law Firm can review your case and assess whether a federal lawsuit may be an option for you.
Mandamus Lawsuit
A mandamus lawsuit asks a federal court to require an agency to fulfill a legal duty. In appropriate cases, it can seek a decision on a delayed application.
APA Lawsuit
The Administrative Procedure Act (APA) allows challenges to unlawful agency actions or unreasonable delays. Whether a claim is available depends on the facts of your case.
Mandamus and APA claims may be brought in the same lawsuit.
Filing a lawsuit does not guarantee approval of your application or automatically extend your work authorization.
Which Application Is Pending?
Find your pending application before completing the form.
Work permit
I-765 is the application form; an EAD is the work permit card. Choose “initial application” for your first card in that category, or “renewal” to renew a card in the same category.
H-4 work permit
Choose this category if you applied for work authorization as the H-4 spouse of an H-1B holder. H-4 status and work authorization involve separate processes, so the form asks about both.
Green Card
Choose I-485 if your application for permanent residence from within the United States is pending. If only your related work permit is delayed, choose a work permit category.
Family petition
Choose this option if an I-130 petition filed by your U.S. citizen or permanent resident relative to establish a qualifying family relationship is pending.
Extension or change of status
Choose this option if your I-539 application to extend or change temporary immigration status is pending, such as an H-4 extension.
Naturalization
Choose N-400 if your naturalization application is pending. If you have had an interview, you can include the date in the additional information field.
Visa application
Choose this option if your visa case is pending at a U.S. embassy or consulate. Include your interview date and any administrative processing details, if applicable.
Not sure?
If your application is not listed or you are unsure of the category, choose “Other / Not sure.” Briefly describe the application that is pending.
