Group Lawsuit Participation Application for DV-2026 Selectees

If your DV-2026 case is stalled due to visa issuance or processing delays,

Who can participate?

Who can apply?

You may apply if you are a DV-2026 selectee and your case is either in consular processing outside the U.S. or adjustment of status inside the U.S.

Eligible applicants include:

DS-260 submitted, pending processing

Attended an interview and placed under 221(g)

Facing refusal or barriers under 212(f) or a presidential proclamation

DV-2026 selectees with spouses/children as derivative beneficiaries

Filed I-485 and currently pending

Purpose of the Lawsuit

This lawsuit aims to seek legal relief from the court against the general suspension and processing barriers affecting DV-2026 selectees’ cases. The goal is to pursue judicial action so eligible applicants’ cases can be processed, or the existing barrier removed, before the DV-2026 period expires.

This process does not guarantee the removal of every legal or administrative obstacle.

In particular:

  • A visa is not guaranteed.
  • A successful outcome is not guaranteed.
  • Class certification is not guaranteed.
  • Individual correspondence with the consulate or case follow-up is not included in the scope of representation.
  • Travel bans, public charge issues, security screening, or individual inadmissibility grounds may require separate evaluation.
  • Claims involving 221(g), 212(f), or other refusal/suspension situations may be more complex.

Participation Fee

The participation fee applies to the principal DV-2026 selectee. If the spouse and children are included in the same case as derivative beneficiaries, the agreement will clearly state whether any additional fee applies.

Participation Process

1. Complete the Eligibility Form
Submit your DV-2026 selectee information, case number range, country, case status, and contact details.

2. Preliminary Review
Our team reviews the basic participation requirements and any potential risks in your case.

3. Review the Representation Agreement
The fee, scope, risks, and responsibilities will be shared in writing.

4. Submit Required Documents
You may be asked to provide your DV selection notice, DS-260 status, interview/refusal documents, and family information.

5. Inclusion in the Lawsuit File
Information from eligible participants will be organized for use in lawsuit preparation.

6. Stay Informed of Updates
Participants will be informed about the lawsuit process, court schedule, and important developments.
