gelmesi durumunda \u00e7ocuklar\u0131n gelece\u011finin ne olaca\u011f\u0131d\u0131r.<\/p><p data-path-to-node=\"2\">\u00d6zellikle T\u00fcrk ailelerde s\u0131k\u00e7a sorulan temel soru \u015fudur:<\/p><p data-path-to-node=\"3\"><strong>\u201cE\u011fer e\u015fimle bana bir \u015fey olursa \u00e7ocuklar\u0131m\u0131za ne olacak?\u201d<\/strong><\/p><p data-path-to-node=\"4\">Bu soru, yaln\u0131zca duygusal bir endi\u015fe de\u011fil, ayn\u0131 zamanda ABD aile hukuku, eyalet mahkemeleri uygulamalar\u0131 ve \u00e7ocuk koruma sistemi a\u00e7\u0131s\u0131ndan teknik bir hukuki Uygunluk (Best Interest of the Child)<\/b><\/p><p data-path-to-node=\"7\"><strong>Mahkemeler, ebeveynlerin vasiyetine \u00f6nem vermekle birlikte, vasiyetle ortaya konan \u00f6l\u00fcme ba\u011fl\u0131 irade mahkeme i\u00e7in ba\u011flay\u0131c\u0131 de\u011fildir.<\/strong> Kural olarak, her eyalet mahkemesi \u00e7ocu\u011fun fiziksel, duygusal, e\u011fitimsel ve sosyal refah\u0131n\u0131 esas alarak ba\u011f\u0131ms\u0131z de\u011ferlendirme yapar. <strong>Ancak ebeveynlerin niyetine ayk\u0131r\u0131 hareket etmesi \u00e7ok nadirdir.<\/strong><\/p><p data-path-to-node=\"8\">Bu yakla\u015f\u0131m, ABD aile hukukunun temel prensiplerinden biridir ve t\u00fcm eyaletlerde uygulan\u0131r.<\/p><h2 data-path-to-node=\"9\"><strong>Vasiyet (Will) \u00c7ocuk Velayetini Belirler mi?<\/strong><\/h2><p data-path-to-node=\"10\">ABD\u2019de bir\u00e7ok ebeveynin yanl\u0131\u015f bildi\u011fi en \u00f6nemli konu \u015fudur:<\/p><p data-path-to-node=\"11\"><strong>\u201cVasiyetname tek ba\u015f\u0131na velayet tayin etmez.\u201d<\/strong><\/p><p data-path-to-node=\"12\">Bir vasiyetname i\u00e7erisinde guardian atanmas\u0131 m\u00fcmk\u00fcnd\u00fcr; ancak bu atama:<\/p><ul data-path-to-node=\"13\"><li><p data-path-to-node=\"13,0,0\"><strong>Ba\u011flay\u0131c\u0131 de\u011fildir.<\/strong><\/p><\/li><li><p data-path-to-node=\"13,1,0\"><strong>Mahkeme onay\u0131na tabidir.<\/strong><\/p><\/li><li><p data-path-to-node=\"13,2,0\"><strong>Sadece \u201cg\u00fc\u00e7l\u00fc bir tercih beyan\u0131\u201d niteli\u011findedir.<\/strong><\/p><\/li><\/ul><p data-path-to-node=\"14\">Eyalet mahkemesi, vasiyette belirtilen ki\u015fiyi genellikle dikkate al\u0131r; ancak \u00e7ocu\u011fun yarar\u0131 verir.<\/strong><\/p><\/li><li><p data-path-to-node=\"18,3,0\"><strong>\u00c7ocu\u011fun ya\u015fam d\u00fczenini y\u00f6netir.<\/strong><\/p><\/li><\/ul><p data-path-to-node=\"19\">Ancak guardian:<\/p><ul data-path-to-node=\"20\"><li><p data-path-to-node=\"20,0,0\"><strong>Ebeveynin yerini tamamen almaz.<\/strong><\/p><\/li><li><p data-path-to-node=\"20,1,0\"><strong>Otomatik evlat edinme hakk\u0131 kazanmaz.<\/strong><\/p><\/li><\/ul><p data-path-to-node=\"21\">Guardianship karar\u0131 her zaman mahkeme taraf\u0131ndan verilir ve denetlenir.<\/p><h2 data-path-to-node=\"22\"><strong>Ebeveynlerin Vefat\u0131 Halinde Hukuki S\u00fcre\u00e7<\/strong><\/h2><p data-path-to-node=\"23\">Her iki ebeveynin de vefat\u0131 veya \u00e7ocuk bak\u0131m\u0131n\u0131 s\u00fcrd\u00fcrememesi h\u00e2linde s\u00fcre\u00e7 genellikle \u015fu \u015fekilde ilerler:<\/p><ol start=\"1\" data-path-to-node=\"24\"><li><p data-path-to-node=\"24,1,0\"><b data-path-to-node=\"24,1,0\" data-index-in-node=\"0\">Ge\u00e7ici koruma:<\/b><\/p><p data-path-to-node=\"24,1,0\">\u00c7ocuk, k\u0131sa s\u00fcreli olarak devlet data-path-to-node=\"29\">T\u00fcrkiye\u2019deki b\u00fcy\u00fckanne, b\u00fcy\u00fckbaba veya di\u011fer yak\u0131n akrabalar:<\/p><ul data-path-to-node=\"30\"><li><p data-path-to-node=\"30,0,0\"><strong>ABD mahkemesine guardian olarak ba\u015fvurabilir.<\/strong><\/p><\/li><li><p data-path-to-node=\"30,1,0\"><strong>\u00c7ocu\u011fun bak\u0131m\u0131n\u0131 data-index-in-node=\"0\">T\u00fcrkiye\u2019deki aile bireylerinin otomatik bir velayet hakk\u0131 yoktur.<\/b><\/p><p data-path-to-node=\"33\">Mahkeme \u015fu sorulara odaklan\u0131r:<\/p><ul data-path-to-node=\"34\"><li><p data-path-to-node=\"34,0,0\"><strong>\u00c7ocu\u011fun ABD\u2019de kalmas\u0131 m\u0131 daha stabil?<\/strong><\/p><\/li><li><p data-path-to-node=\"35\">Bu nedenle T\u00fcrkiye\u2019ye g\u00f6nderim hi\u00e7bir zaman otomatik bir sonu\u00e7 de\u011fildir.<\/p><h2 data-path-to-node=\"36\"><strong>\u00c7ocu\u011fun ABD Vatanda\u015f\u0131 Olmas\u0131 Durumu<\/strong><\/h2><p data-path-to-node=\"37\">E\u011fer \u00e7ocuk ABD vatanda\u015f\u0131ysa, s\u00fcre\u00e7 daha da hassas h\u00e2le gelir:<\/p><ul data-path-to-node=\"38\"><li><p data-path-to-node=\"38,0,0\"><strong>\u00c7ocuk ABD hukuk sisteminin tam korumas\u0131 alt\u0131ndad\u0131r.<\/strong><\/p><\/li><li><p
