In the event the title company fails in the closing process to pay the judgment that has been recorded, as a courtesy to the new owner, you may wish to attempt to resolve the matter informally with the title company first. Immediately going after the lien on the new owner’s property may cause the new owner—who is likely innocent—significant inconvenience and expense. However, if the title company refuses to make good on its mistake, steps need to be taken immediately to collect on the lien.
