Overtime clock

As an employer, it is important to ensure that overtime is always promptly paid to all non-exempt workers. Workers who are not entitled to overtime (exempt workers) include professionals such as doctors and attorneys, certain types of managers who manage two or more full-time employees, and certain administrative workers who have substantial autonomy, discretion and responsibility.

The determination of whether a particular employee falls within these categories is a factually intensive question dependent upon the unique circumstances of each employment situation. If there is any question as to whether a particular employee is exempt, it is important to get prompt advice from an attorney familiar with the applicable regulations.
