Why PERM Matters?
Step-by-Step Overview of PERM
1. Pre-Filing Preparation:
A job description is developed based on legitimate business needs. The employer then requests a Prevailing Wage Determination (PWD) from the DOL, which sets the minimum wage for the position based on its location and duties.
2. Recruitment Process:
After receiving the PWD, the employer conducts a good-faith recruitment effort. This includes: Advertising in high-circulation newspapers. Posting job ads in relevant job search platforms. Documenting all recruitment steps, including interview outcomes.
3. Filing the PERM Application:
If no able and qualified U.S. worker is found during recruitment, the employer files the ETA Form 9089 with the DOL. As of early 2025, processing times for PERM applications may exceed 15 months. Audits or Requests for Additional Evidence can prolong this timeline further.
4. I-140 Immigrant Petition: Once the PERM is approved, the employer can file Form I-140, Immigrant Petition for Alien Worker. This stage establishes the foreign worker’s eligibility for a Green Card under categories such as EB-2 or EB-3.
5. Visa Bulletin and Priority Dates:
Approval of the I-140 petition does not mean the applicant can immediately apply for a Green Card. They must wait for their priority date to become current based on the Visa Bulletin, which is subject to annual quotas and per-country limits.
6. Adjustment of Status (Form I-485): When the priority date becomes current, the applicant can file Form I-485 to adjust status to permanent residency. This final stage can also take several months to a few years, depending on category and nationality.
